Chapter 4 - The Legal Standard

By the third day, Mia was walking down the hallway, holding Michael’s hand as she pushed her own IV pole. The color had returned to her cheeks, and her laughter filled the sterile corridor. Dr. Reyes had told Michael that she could likely be discharged the following morning, provided her oxygen levels remained stable overnight.

But Michael knew she couldn't go back to the house. Not yet.

He had spent the previous evening speaking with a family law attorney recommended by Dr. Reyes. Her name was Evelyn Vance (no relation to Lorraine, much to Michael’s relief), a sharp-witted woman with a reputation for being an absolute shark in custody disputes.

Evelyn arrived at the hospital room during visiting hours, carrying a leather briefcase. She was a woman in her late forties, dressed in a tailored navy suit, with a direct, no-nonsense demeanor.

"Mr. Porter," Evelyn said, shaking his hand firmly. "I’ve reviewed the financial documents you emailed me, as well as the preliminary incident report from the hospital security and Dr. Reyes."

"And?" Michael asked, gesturing for her to sit at the small table.

"And you have a very strong case, but we need to play this perfectly," Evelyn said, opening her briefcase and pulling out a stack of papers. "First, the custody. What your wife did—removing Mia’s oxygen mask—is legally considered reckless endangerment of a child. I’ve already drafted a petition for an Emergency Temporary Custody Order. With Dr. Reyes's signed affidavit and the hospital security footage, which my office has already subpoenaed, a judge will sign this by this afternoon."

Michael felt a massive wave of relief wash over him. "So she can't take Mia?"

"No. Once the judge signs this, Tessa will be barred from having unsupervised contact with Mia. She will only be allowed supervised visits at a designated county facility, pending a full evidentiary hearing."

"What about the money?" Michael asked, his eyes darkening. "The embezzlement?"

Evelyn leaned forward, her expression turning deadly serious. "The financial fraud is massive. What your wife and mother-in-law did isn't just a divorce dispute; it's grand theft and corporate embezzlement. Because they used dummy vendors and interstate banking routing systems, this actually touches on federal wire fraud."

"I don't want to put my wife in prison if I can avoid it," Michael said quietly, thinking of Mia. "But I want every cent back. And I want her mother gone. Entirely out of our lives."

Evelyn nodded understandingly. "I appreciate your restraint, Michael. But you need to understand that Lorraine Vance is a parasite. She has likely been doing this her entire life, using her daughter as a conduit. We will use the threat of criminal prosecution as leverage. We will offer Tessa a deal: she signs over full legal and physical custody of Mia, agrees to a nominal, supervised visitation schedule, waives all rights to alimony, and signs over her share of the marital home and your business. In exchange, you won't file formal criminal charges for the embezzlement."

"And Lorraine?"

"Lorraine doesn't get a deal," Evelyn said coldly. "We are going after her personally for the recovery of the stolen funds. I’ve already drafted a freeze on her personal and business assets. By tomorrow morning, her bank accounts will be locked."

Just as Evelyn finished speaking, Michael’s phone buzzed on the table. It was an unknown number. He answered it and put it on speaker.

"Michael," Tessa’s voice came through, sounding frantic and angry. "You have to tell these doctors to let me in! I’m downstairs in the lobby, and security won't let me past the elevators!"

Michael looked at Evelyn, who gave him a sharp nod to proceed.

"You're not allowed up here, Tessa," Michael said, his voice steady and calm. "Dr. Reyes barred you. And frankly, so did I."

"You can't do this!" she screamed, her voice cracking. "I am her mother! You're turning her against me! My mother is calling her lawyers right now, Michael. We are going to take the shop, we are going to take the house, and you will never see Mia again!"

"Tessa," Michael said, his voice dropping an octave, filled with a quiet strength that made his wife pause on the other end of the line. "I know about L&T Consulting. I know about Apex Auto Parts and Valley Lubricants. I know you’ve stolen over two hundred and thirty thousand dollars from my business and our personal accounts."

There was a sudden, dead silence on the line.

"I... I don't know what you're talking about," Tessa stammered, her confidence instantly evaporating.

"My attorney is sitting right next to me," Michael continued. "By this afternoon, a judge will sign an emergency custody order. Tomorrow, your mother's accounts will be frozen. If you want to avoid going to jail, you will do exactly what my lawyer says. Do not call me again. Have your attorney contact Evelyn Vance."

He hung up the phone. For the first time in years, Michael felt like he could breathe.
