Chapter 7 - The Guardianship Hearing

Friday morning arrived under a gray, overcast sky. The county courthouse felt cold and imposing as David and I walked down the long marble corridor toward Family Courtroom 3B.
Ruby remained at home under the care of a court-certified temporary guardian and CPS worker, protected from the distress of the legal battle unfolding in the courtroom.
When we stepped inside, Paula was already seated at the defense table. She wore a modest blue dress, her hair pulled back into a neat bun, looking fragile and subdued. Beside her sat her defense attorney, a sharp-looking man in a grey suit. Sergio was absent, currently held in county jail without bail on felony child abuse charges.
Paula looked up as I walked in. For a second, a flicker of pure hatred flashed in her eyes before she quickly forced her head down, wiping away an imaginary tear.
Judge Catherine Holmes presided over the court. She was a woman in her late fifties with sharp eyes that scanned the courtroom with piercing authority.
"We are here today regarding the emergency temporary custody of Ruby Miller," Judge Holmes began, her voice echoing off the wood-paneled walls. "State the appearances for the record."
After the attorneys introduced themselves, the prosecutor presented the state's findings, laying out the horrifying evidence: Dr. Aris’s medical reports, the police report from the night of the arrest, and Ms. Vance’s detailed thirty-page journal.
Paula’s attorney stood up to offer his defense. "Your Honor, my client, Paula, was under the emotional and physical control of her co-defendant, Sergio. She was a victim of severe domestic coercion. She brought Ruby to her brother’s house specifically to protect her when she realized the danger. She is a grieving mother seeking help to rebuild her life with her daughter."
I sat at the table, my fists clenched so hard my knuckles turned white.
Judge Holmes leaned forward, resting her chin on her hands. "Counselor, if your client brought the child to her brother to protect her, why did she return at midnight with the alleged abuser to demand the child back? Why did she threaten her brother when he refused to release a starved child into the night?"
The defense attorney stumbled, glancing back at Paula. "Your Honor... my client was under extreme duress—"
"That is enough," Judge Holmes interrupted coldly. She turned her eyes to Paula. "Mrs. Miller, I have reviewed the medical logs. A five-year-old child under your care was subjected to systematic starvation and physical restraint. The evidence does not show a protective mother; it shows a accomplice to torture."
Judge Holmes struck her gavel with a sharp, decisive thud.
"Temporary legal and physical custody of Ruby Miller is hereby granted immediately to her uncle, Mark. A full protective order is issued against Paula Miller and Sergio Ramos. They are to have zero contact, direct or indirect, with the minor child pending the outcome of their criminal trial."
I let out a long, ragged breath as David slapped me lightly on the shoulder.

As Paula was led away by courtroom bailiffs, she turned to me and shrieked, "She’s my daughter, Mark! You stole my daughter!"
I didn't answer her. I turned my back and walked out of the courtroom, heading home to the child who was finally safe.
