Chapter 5 - The Legal Battle Begins

By three in the morning, an emergency CPS caseworker named Sarah Jenkins arrived at the house. She was a composed, perceptive woman who spoke softly and moved with measured calm.

After reviewing Ms. Vance’s documentation and speaking privately with Ruby for thirty minutes in the living room—using drawing paper and stuffed animals to ease her anxiety—Sarah returned to the kitchen where I was brewing a pot of black coffee.

"The situation is severe, Mark," Sarah said, placing a thick manila folder on the kitchen table. "Paula and Sergio are currently being held at the county jail. The police are filing formal charges for child endangerment, criminal neglect, and unlawful restraint."

"Good," I said fiercely. "Keep them there forever."

"It’s not quite that simple," Sarah warned gently. "Paula is her biological mother. While the state has taken temporary emergency custody tonight and placed Ruby with you, Paula will be appointed a public defender. She will fight this. Her defense will likely argue that Sergio was the primary aggressor and that she was a victim of domestic coercion, or that you are manipulating the child to take custody."

"That's insane," I snapped. "You saw the note! You saw Ruby's physical condition!"

"I did," Sarah said calmly. "And physically, Ruby is severely underweight for a five-year-old. Her growth charts from her pediatrician haven't been updated in eighteen months. We are taking her to a pediatric specialist tomorrow morning for a full medical examination and forensic interview. That evidence will be crucial."

"What do I need to do?" I asked, leaning forward on the table. "Tell me what I have to do to keep her."

"You need a good family law attorney immediately," Sarah advised. "You need to prepare for a temporary guardianship hearing in family court this Friday. Paula’s lawyers will try to get Ruby placed in foster care rather than with family if they think you are hostile toward her. You must remain calm, documented, and focused entirely on Ruby’s best interests."

After Sarah left, I didn't sleep. I sat in the living room watching the sunrise over the neighborhood.

At 8:00 AM, I made a call to David Miller, a veteran family law attorney recommended by a colleague. By noon, David was sitting in my living room, reviewing the police reports, Ms. Vance's letter, and the CPS initial intake form.

"We have a strong case, Mark," David said, tapping his pen against his pad. "The physical evidence of malnutrition combined with the school's written record gives us a significant advantage. But family courts prioritize biological parents whenever possible. Paula will try to play the victim. She will clean herself up, cry in front of the judge, and claim she was terrified of Sergio."

"She sat on my porch and called her daughter a dramatic liar," I said, my teeth clenched. "She knew exactly what she was doing."

"Then we have to prove it," David said grimly. "We need every record, every message, every witness. We need her school, her doctors, and her neighbors. We are going to build an airtight wall around Ruby that no lawyer can tear down."
