Chapter 7 - The Deposition and the Hidden Recording

Three weeks later, we were in a high-rise conference room in downtown city center for Brian’s formal deposition.

Brian sat across the long glass table, flanked by his high-priced defense attorney, Richard Vance. Brian looked terrible. He had lost weight, his expensive suit hung loosely on his frame, and the arrogant smirk was completely gone, replaced by a nervous, twitching energy.

Donna sat in the corner of the room, looking older and more fragile than I had ever seen her. Her social circle had completely abandoned her, and she was facing potential conspiracy charges for her involvement in D&B Holdings.

Andrew sat next to me, calmly organizing his files.

"Let the record show that this is the deposition of Brian Evans in the matter of Evans v. Evans," Andrew began, turning on the video recorder. "Mr. Evans, let's start with the night of October 14th. Did you, or did you not, strike your wife across the face when she attempted to take your daughter to the emergency room?"

Brian looked at his attorney, who nodded subtly.

"I did not strike her," Brian said, his voice flat. "As I’ve stated before, my wife was hysterical. She was screaming and throwing things. I reached out to grab her shoulders to calm her down, and she tripped over the hallway rug, causing her cheek to hit the doorframe."

"I see," Andrew said, not looking surprised. "And your mother, Donna Evans, witnessed this 'accident'?"

"Yes," Brian said. "She will testify to the same."

"And the twelve guests who were in the dining room?"

"They heard the commotion but didn't see the physical interaction," Brian replied smoothly. "But they can confirm my wife was acting in an unstable manner before she left."

Andrew nodded slowly. He opened a manila folder and pulled out a small USB drive.

"Mr. Evans, do you recognize this?" Andrew asked, holding up the drive.

Brian frowned. "No."

"This is a digital file retrieved from your home’s smart-home security system," Andrew said. "You see, when you set up the security cameras in the hallway and living room, you assumed that the data was only stored on your local hard drive, which you conveniently wiped the morning after the incident."

Brian’s face suddenly went rigid. He stared at the USB drive as if it were a venomous snake.

"However," Andrew continued, a cold, triumphant smile spreading across his lips, "you forgot that the system automatically backs up all audio and video data to a secure cloud server every 24 hours. My forensic IT team was able to retrieve the complete, unedited footage from the cloud."

Andrew plugged the USB drive into his laptop and turned the screen toward Brian and his attorney. He hit play.

The video was crystal clear.

On the screen, I was holding Lily, trying to reach the door. Donna was blocking my path, shouting at me. Then, Brian walked in. The audio captured every word.

“Can it wait another hour? Mom has people visiting.”

Then, the video showed me trying to step around them. Donna grabbed my arm. I pulled free. And then, with terrifying clarity, the video showed Brian stepping forward and delivering a brutal, open-handed slap to my face. The sound of the impact echoed through the conference room.

The video continued, showing Donna’s satisfied smile, my shocked expression, and Brian’s momentary look of panic.

"No... that's... that's fabricated," Brian stammered, his voice cracking, sweat breaking out on his forehead. "That video has been edited! It’s deep-fake technology!"

"Mr. Evans, this footage has been authenticated by the county sheriff's department and a certified digital forensic expert," Andrew said, his voice hard as steel. "You lied under oath. That is perjury, a felony. And it completely destroys your defense."

Brian's attorney, Richard Vance, let out a deep sigh. He leaned over and whispered angrily in Brian’s ear. Brian slumped back in his chair, his face pale, staring blankly at the table.

"But we're not done," Andrew said, pulling out another set of documents. "Let’s talk about D&B Holdings. Mr. Evans, did you forge your wife’s signature on these fifteen commercial loan documents and the refinancing of your marital home?"

"I... I had power of attorney," Brian muttered.

"No, you did not," Andrew replied, tossing a copy of the forged power of attorney document onto the table. "This document was forged as well. We have the tracing paper we found in your safe, complete with your fingerprints and DNA on the pages. We also have the testimony of the notary public, who has confessed to accepting a $10,000 bribe from you to notarize these documents without my sister being present."

Donna let out a soft moan in the corner, covering her face with her hands.

Richard Vance put his pen down and looked at Andrew. "Andrew, let's take a recess. We want to discuss a settlement."

"There is no settlement, Richard," Andrew said, looking directly at Brian. "My client is taking the house, the business, all remaining domestic assets, and sole physical and legal custody of Lily. Your client will have supervised visitation only, at our discretion, once he completes a court-ordered anger management program and a psychological evaluation."

"And the offshore accounts?" Vance asked.

"The federal government has already frozen those accounts," Andrew smiled. "The IRS is filing formal charges of tax evasion and money laundering against both Brian and Donna Evans tomorrow morning. Your clients are going to prison, Richard. The only question is how many years they want to serve."

Brian looked up, his eyes filled with tears of rage and desperation. He looked at me, pleadingly. "Sarah, please. We have a daughter. You can't do this to me. I did it for us! I did it to build a future for our family!"

I looked at the man who had once been my husband. I felt no anger, no hatred. I felt only a profound sense of pity for a man so consumed by greed and arrogance that he had destroyed his own life.

"No, Brian," I said, my voice quiet but incredibly firm. "You did it for yourself. You never loved me. You never loved Lily. You only loved the power you thought you had over us. But that power is gone. You have nothing left."
