Chapter 5 - THE TEMPORARY INJUNCTION

Judge Sterling adjusted her glasses and leaned forward, resting her elbows on the mahogany bench. The courtroom was dead silent, every eye fixed on the judge as she prepared to deliver her ruling.

"The petition by the intended parents, Ethan and Claire Whitmore, to dissolve all parental duties and declare the surrogacy contract void due to breach is hereby denied," Judge Sterling announced, striking her gavel once.

A collective gasp echoed through the gallery. Claire Whitmore buried her face in her hands, while Ethan stared straight ahead in stunned disbelief.

"However," Judge Sterling continued, raising a hand to quiet the murmurs, "given the complex medical needs of the child and the serious, credible allegations of document tampering and administrative fraud at Valley View Fertility Center, this court orders the following interim measures:"

Immediate Temporary Custody: Full physical and legal interim custody of the infant Noah Monroe is granted exclusively to Rachel Monroe, effective immediately, pending a full forensic investigation into the medical records.

Medical Financial Mandate: All ongoing medical, surgical, and therapeutic expenses for the infant Noah shall be temporarily funded through an escrow account maintained by the Whitmore Family Foundation, pending final determination of liability and damages.

Criminal Subpoena: The state prosecutor’s office is hereby directed to open an immediate inquiry into the digital override logs and forged signature documents originating from Valley View Fertility Center.

"Court is adjourned," Judge Sterling said, striking her gavel with finality.

Rachel sat back in her chair, closing her eyes as a wave of overwhelming relief washed over her. She had won the first round. She was legally allowed to be Noah’s mother, at least for now.

As she walked out of the courtroom, flashes of cameras blinded her. Reporters shouted questions from every direction.

"Ms. Monroe! Do you have a comment on the Whitmores abandoning your son?" "Rachel, how do you plan to afford his long-term surgeries?"

She ignored them all, keeping her head high as Marcus Vance escorted her past the media throng and straight to a waiting taxi.

"We won the preliminary injunction," Vance said with a satisfied grin as the cab pulled away from the curb. "They can't touch him, Rachel. And the financial mandate means the hospital bills are covered while we build our civil fraud and punitive damages case against the clinic and the Whitmores."

"Thank you, Marcus," Rachel said, her voice shaking slightly with emotion. "I couldn't have done this alone."

"You didn't do it alone. You had the truth on your side," Vance replied. "Now, go back to the hospital. Your son is waiting for his mother."
