Chapter 6 - The Custody Battle

While the criminal case was moving through the court system, the family court hearing for full legal and physical custody was fast-tracked.
The courtroom was packed. Nathan sat at the defense table with two high-powered family attorneys. He looked terrible—his pristine suits were gone, replaced by a rumpled navy jacket, dark circles hanging under his hollow eyes. Evelyn sat in the gallery behind him, looking sharp and angry, surrounded by her legal representatives.
Nathan's lead attorney took the floor, attempting to portray Nathan as a devoted father who suffered a momentary lapse in judgment due to stress.
"Your Honor," the attorney argued, "Mr. Vance is a respected member of the community who has provided a lavish lifestyle for his child. This was a isolated, unfortunate event compounded by a malfunction of the restaurant's exit system."
Eleanor stood up calmly. She didn't raise her voice; she let the evidence speak.
She presented the medical reports from the ER, the temperature records of that night, and the full unedited surveillance video. She called the ER doctor to the stand, who testified under oath that Oliver’s core temperature was dangerously low and that another thirty minutes would have resulted in cardiac arrest or severe frostbite loss of limbs.
Then Eleanor called the restaurant server, a young woman named Sarah-Jane.
"Sarah-Jane, can you tell the court what happened when you served the table that night?" Eleanor asked.
"I asked Mr. Vance twice if the little boy outside was with them," Sarah-Jane testified, her voice shaking slightly but firm. "I told him it was below freezing on the patio. Mr. Vance told me to mind my own business and that the boy was 'learning a lesson.' When I offered to bring the boy a hot chocolate, the older lady—Mrs. Evelyn Vance—told me if I interfered, she would get me fired."
A loud murmur spread across the courtroom. The judge slammed her gavel down, her face dark with indignation.
Nathan slumped in his chair, hiding his face in his hands. His lawyer sat down, unable to salvage the argument.
The judge looked down at Nathan with absolute disdain. "Mr. Vance, your actions—and your inaction—demonstrate a profound, appalling lack of basic human empathy and paternal duty. You allowed your six-year-old child to suffer in freezing temperatures to satisfy a cruel discipline tactic dictated by your family."
The judge didn't deliberate for long.

She granted me permanent, sole legal and physical custody of Oliver. Nathan was stripped of all visitation rights pending the outcome of his criminal trial, and even then, any future contact would require supervised psychological evaluations and strict court oversight.
As we walked out of the courtroom, Eleanor turned to me with a small smile. "That’s step one, Sarah. Now comes the criminal trial."
