Chapter 3 - Gathering the Evidence

Monday morning arrived with a sharp, crisp breeze that rustled the autumn leaves outside the Michigan house. Back home in my office, my tax files waited, but my focus was entirely on helping Ashley secure a future where Dan could never again disrupt these innocent children's lives.

Dominic, Ashley’s father, sat at the dining room table surrounded by legal pads, highlighters, and printed copies of text message threads. He had spent the early morning hours reviewing the digital paper trail I had forwarded to him.

"This is textbook abandonment," Dominic said, adjusting his reading glasses as he pointed a pen at a printed transcript of Dan's text messages. "He explicitly stated he was leaving them with you indefinitely, refusing to take responsibility, and shifting his parental duties without any legal framework or consent. Furthermore, his previous history of leaving Ashley to bear the sole financial and emotional burden will heavily support our case for sole legal and physical custody."

"What about visitation?" Ashley asked, sitting across from him with a cup of coffee. "Does he get supervised visits?"

"Given his track record of unreliability, a court will likely grant him supervised visitation, but only if he petitions for it and meets strict conditions—such as stable housing, employment, and passing parenting classes," Dominic explained, writing notes down rapidly. "Most likely, he won't even bother once he realizes he actually has to put in effort. Men like Dan prefer the idea of fatherhood over the actual execution of it."

My phone buzzed on the table. I picked it up.

It was a text message from Dan: How are things going? Kids behaving? Don't call me until evening, I'm working on a new track.

I looked at Dominic and Ashley. A quiet, knowing smile crossed Ashley’s face.

"Don't answer right away," Ashley advised. "Let him sweat a little bit. Wait until this evening."

Later that afternoon, I finally replied, keeping my tone deceptively neutral: They're adjusting.

Dan’s reply came back almost instantly: Great. Let me know if Lily eats her veggies. Remember, I'm out of pocket for a few days focusing on my music, so don't bother me unless it's an absolute emergency.

I screenshot the conversation and sent it directly to Dominic.

"Perfect," Dominic murmured, adding the timestamped screenshot to the growing stack of evidence. "He is actively reinforcing his abandonment in real time. We are building an airtight case. Ashley, we will file for emergency temporary custody first thing tomorrow morning, citing abandonment and immediate welfare concerns."

Ashley reached across the table and squeezed my hand. "Thank you, Claire. You didn't have to get dragged into this mess, but you stood up for them."

"He's my brother, but what he did was unforgivable," I said softly, looking toward the living room where Lily and Ben were happily playing with building blocks with their grandparents. "It's time he learned that human beings aren't items you can just put in storage when they become inconvenient."
