Chapter 5 - Unraveling the Trust

Marcus adjusted his reading glasses and pulled out the sealed document bearing my father's signature and the official state seal.
"Under the revised terms of the Arthur Pendelton Revocable Living Trust," Marcus read aloud, "the total value of the estate—including the construction company proceeds, commercial real estate holdings, and liquid investment portfolios—is valued at approximately fourteen million dollars."
Ryan gasped softly, while Dana's eyes widened in disbelief. They had estimated the estate at half that amount.
"First," Marcus continued, "the family homestead—the house where Patricia currently resides—was placed entirely into a sub-trust. Patricia holds a life estate, meaning she may live there for the duration of her life. However, ownership of the property does not belong to her, nor does it pass to Ryan or Dana."
"What?" my mother voiced, her knuckles turning white as she gripped her purse. "It’s my house!"
"It was purchased solely in Arthur’s name prior to your marriage’s financial restructuring," Marcus corrected gently. "Upon your passing—or should you choose to vacate it—the property title transfers automatically and entirely to the Arthur Pendelton Foundation for Child Adoption and Care, a charitable entity managed exclusively by Claire."
Dana slammed her hand on the table. "That’s insane! That house is worth two million dollars! What about Ryan and me?"
"I am getting to that," Marcus said calmly, turning the page. "Regarding direct cash distributions: Ryan and Dana are each allocated a lump-sum inheritance of fifty thousand dollars."
"Fifty thousand?!" Ryan practically yelled, standing up out of his chair. "Are you out of your mind?! Dad had millions! Fifty grand is a insult!"
"Sit down, Mr. Pendelton," attorney Harrison warned his client, though Harrison himself looked deeply uncomfortable.
"The remainder of the liquid assets—approximately twelve million dollars," Marcus read on, ignoring the outburst, "has been divided into three equal shares of four million dollars each. Share one is placed into an irrevocable educational and life fund for Lily Pendelton. Share two is placed into an irrevocable educational and life fund for Noah Pendelton."
The room went dead silent. The sound of my mother's harsh breathing filled the space.
"And share three?" Harrison asked, his voice subdued.
"Share three," Marcus said, looking directly at my mother, "is held in trust for Claire Pendelton, with full discretionary power over the funds starting immediately."

My mother slumped back into her chair, her face pale and drawn. "He left everything... to the adopted kids? And Claire?"
"He left his legacy to the daughter who showed unconditional love," Marcus said softly, closing the folder with a definitive thud. "And to the grandchildren who brought him pure joy in his final days."
