Chapter 8 - The Plea Offer

Two weeks after the arrest, my phone rang while I was making dinner. It was Detective Vance.
“Clara,” he said without preamble. “The defense has submitted a formal plea proposal through the DA’s office.”
I turned off the burner beneath the pasta pot, wiping my hands on a dish towel. “What kind of proposal?”
“Megan’s attorney is trying to avoid a felony conviction going on her record,” Vance explained, his tone professional and measured. “They want to plead guilty to a reduced misdemeanor charge of reckless endangerment, with two years of supervised probation, mandatory psychological counseling, and community service. No jail time.”
I stared out the kitchen window into the dark backyard. “And the DA?”
“The DA is inclined to accept it if you sign off on the victim impact statement supporting the resolution,” Vance said carefully. “The state feels confident we’d win at trial, but trials take a heavy toll on witnesses, especially five-year-old victims if they have to testify. However, the decision ultimately rests with you. If you want to push for the full felony trial, we will back you all the way.”
Silence stretched across the line.
I thought about Megan sitting in that courtroom in her orange jumpsuit, glaring at me with unfiltered hatred. I thought about Mom calling every relative in the state to play the martyr. I thought about Lily sleeping peacefully in her room upstairs, finally smiling again.
“Detective,” I said softly. “If she takes the misdemeanor plea, does it include a permanent protective order keeping her away from me and Lily?”
“Indefinitely,” Vance replied. “Any violation results in immediate revocation of probation and mandatory jail time.”
“Does it include court-ordered psychological evaluation and treatment?”
“Yes. Mandatory, overseen by the court.”
I took a deep breath. I didn't need a public spectacle or a courtroom drama to validate what happened. I needed safety, permanence, and an absolute guarantee that Megan could never, under any circumstances, touch or influence my daughter’s life again.

“Tell the DA I’ll sign,” I said. “On one condition: the protective order must be permanent, non-negotiable, and include my mother’s address if Megan attempts to use it as a loophole to get near Lily.”
“Done,” Detective Vance said immediately. “I’ll draw up the paperwork tonight.”
