Chapter 4 - Gathering Evidence

The morning light crept through the window of Mia’s hospital room. She was asleep, hooked up to an IV and a PCA pump, her right leg encased in a heavy plaster mold and elevated high above her bed. Her face looked small and pale against the white hospital sheets, but her breathing was finally steady and painless.
I sat by her side, laptop open, working with a terrifying clarity of purpose.
My phone rang on silent. It was my father. I declined the call. Seconds later, a text message popped up: David, you need to call me right now. Your mother is hysterical. Caroline is crying. You’re turning a simple misunderstanding into a family tragedy. Call us before this gets out of hand.
I stared at the message, a bitter smile touching my lips. A misunderstanding. A family tragedy. They weren’t worried about Mia’s ability to walk; they were worried about their precious reputation.
I opened a empty document and began typing. I recorded every detail of the evening while it was fresh in my memory: the exact times, the sequence of events, every cruel comment made by my mother, father, brother, and Caroline, and the exact words spoken before Caroline tore off the brace.
An hour later, Detective Marcus Vance from the city police department arrived at the room, accompanied by a social worker from Child Protective Services. Dr. Caldwell had filed an automated mandatory reporter statement overnight, triggering an immediate criminal investigation.
“Mr. Miller?” Detective Vance asked softly, showing his badge. “I’m Detective Vance. I’m here regarding the incident involving your daughter.”
“Thank you for coming so quickly,” I said, standing up to shake his hand. “I have everything ready for you.”
For the next two hours, I provided a detailed statement. Dr. Caldwell joined us, presenting a formal medical report detailing the severe traumatic injury Mia had sustained, complete with high-resolution X-rays showing the shattered orthopedic hardware and tissue damage.
“This isn’t just domestic dispute, Mr. Miller,” Detective Vance noted, his face grim as he reviewed the medical photos. “Given the intentional physical action taken against a disabled minor, this meets the threshold for Felony Child Abuse resulting in Great Bodily Harm, as well as Assault and Battery.”
“I want to press every single charge possible,” I said without a moment’s hesitation. “Not just against Caroline. Against everyone who stood by and facilitated it.”
“We’ll start with the primary actor,” Vance replied. “I’ll be securing an arrest warrant for Caroline Miller today.”
After the police left, I didn’t stop. I called my lawyer, Sarah Jenkins, a relentless family and civil litigation attorney.
“David, I read the preliminary report Dr. Caldwell sent over,” Sarah said over the phone, her voice sharp and professional. “What they did is unconscionable. We are going to hit them from every legal angle imaginable. Criminal charges are step one. Step two is a massive civil lawsuit for intentional infliction of emotional distress, battery, and total compensation for all current and future medical expenses.”

“I don’t care about the money, Sarah,” I said coldly. “I want accountability. I want them to face the consequences of what they did.”
“Trust me,” Sarah responded grimly. “By the time we’re done, they will regret the day they ever treated Mia with anything less than absolute respect.”
