Chapter 5 - The Counter-Attack

Two weeks after the arrests, the legal machine of the Miller family attempted one final, desperate counter-attack.
Gertrude’s brother, Arthur—a retired, sleazy personal injury attorney from Orange County—managed to post bail for Gertrude and Hailey using his own home equity. Brandon, however, remained stuck in county jail, as his bail was set at an unattainable $250,000 due to the severity of the felony real estate fraud charges and flight risk concerns.
Arthur immediately filed a barrage of frivolous motions against me in civil court. He claimed I had "illegally evicted" Gertrude and Hailey without thirty days' written notice, that my hidden camera setup violated California's two-party consent wiretapping laws, and that I was "intentionally inflicting emotional distress" on an elderly woman.
On a Tuesday morning, I sat beside Marcus in a brightly lit civil courtroom in San Bernardino for the preliminary motion hearing. Across the aisle sat Gertrude, wearing a neck brace she clearly didn't need, flanked by Hailey and their smug lawyer uncle, Arthur.
Arthur stood up first, puffing out his chest and adjusting his cheap suit jacket.
"Your Honor," Arthur boomed, directing his voice toward Judge Evelyn Torres. "My client, Gertrude Miller, is a seventy-two-year-old grandmother who was brutally thrown onto the street in the middle of the night by her ruthlessly cold daughter-in-law! Furthermore, the defense relies entirely on video footage obtained through illegal electronic surveillance in a private home! We demand the immediate dismissal of all video evidence, the restoration of tenancy for my clients, and a interim support order of $8,000 a month paid by Charlotte Miller!"
Judge Torres looked over her reading glasses at Arthur, her expression utterly unimpressed. "Mr. Miller, are you finished?"
"I am, Your Honor. The law is clear on privacy protection!"
Marcus Vance calmly stood up, smoothing his navy tie. He didn't raise his voice; his presence radiated supreme authority.
"Your Honor, if I may clarify three simple facts," Marcus began softly. "First, California Penal Code Section 632 explicitly permits the recording of confidential communications if the recording is made for the purpose of obtaining evidence relating to the commission of specific violent crimes or felony crimes involving fraud and extortion. The footage in question clearly documents the defendants actively forging deeds, destroying legal estate documents, and executing a conspiracy to commit grand theft real estate fraud."
Marcus handed a thick binder to the court bailiff to pass to the judge.
"Second," Marcus continued, "regarding the claims of illegal eviction: Gertrude and Hailey Miller were never tenants. They were temporary social guests who signed no lease agreement and paid zero rent. Furthermore, their departure was not an eviction—it was the direct result of a lawful execution of an arrest warrant by the San Bernardino County Sheriff's Department."
Judge Torres flipped through the documents in Marcus's binder, her eyebrows rising with every page.
"And finally, Your Honor," Marcus added, turning his head slightly to glance at Arthur. "Regarding the request for spousal and family interim support: We have filed a cross-motion for complete asset freezing and financial restitution. We have uncovered that over the past thirty-six months, Gertrude Miller personally received over $65,000 in direct transfers from accounts stolen from Charlotte Miller’s sole personal earnings. We are not just rejecting their motion—we are filing for an immediate order of full financial attachment against Gertrude Miller’s personal bank accounts."
Arthur’s face turned pale. He frantically leaned down to whisper to Gertrude, whose eyes widened in sheer panic.
Judge Torres slammed her gavel down with a sharp, echoing CRACK.
"The plaintiff's motions regarding evidence suppression and interim support are DENIED with prejudice," Judge Torres ruled sternly. "The court finds the video evidence entirely admissible under California statutory exceptions for felony fraud investigations. Furthermore, this court issues an immediate freeze on all joint financial vehicles associated with the defendants pending the outcome of the criminal trial."
Gertrude gasped loudly, ripping off her fake neck brace in a fit of rage. "This is a outrage! She's a witch! She worked all day and left us with nothing!"
"Order in the court!" Judge Torres barked, pointing her gavel directly at Gertrude. "One more outburst from you, ma'am, and I will have the bailiff remand you into custody for criminal contempt right now!"
Hailey grabbed her mother's arm, pulling her back down into her seat, tears of embarrassment streaming down her heavily contoured face. They had come into the courtroom expecting to bully a tired, broken woman into giving them a massive cash settlement. Instead, they walked out legally cornered, financially ruined, and exposed to the full weight of the justice system.
As we walked out of the courthouse steps into the bright afternoon sun, Marcus turned to me with a satisfied smile.
"That was the civil side, Charlotte," Marcus said, putting his hands in his pockets. "Now, the District Attorney is ready to go to trial on the criminal charges. Brandon’s public defender is going to beg for a plea bargain. The question is: do you want to offer him one?"

I looked up at the blue California sky, feeling the warm wind against my face. For years, I had let fear and duty dictate my decisions.
"No plea bargains," I said firmly. "Let a jury of his peers decide his fate."
